PRIVACY STATEMENT

The Cove Gifts (referred to as “The Cove Gifts,” “we,” or “us”), a Texas LLC, has created this privacy policy to explain our privacy practices. A user of the Root Recruiting website and/or mobile Site is hereinafter referred to as a “you” or “User(s).”

This privacy policy (“Privacy Policy”) applies only to information that we collect on shopthecovegifts.com (“Store,” or “Site”). This Privacy Policy explains how we collect, use, share, and protect your personal information, which is information that could reasonably be used to identify you individually, such as your name, physical address, e-mail address, GPS location, and mobile number (“Personal Information”). If you do not want us to handle your Personal Information in this manner, please do not use the Site.

By using the Site, you do hereby warrant and represent that you have read, understand and agree to all terms and conditions stated herein, including our Terms of Service, available at [LINK], which is incorporated herein by reference, which govern the use of the services offered by us, and that you are giving us permission to use and store such information consistent with this Privacy Policy and our Terms of Service.

  1. INFORMATION WE COLLECT
  1. a) Information You Give Us

We collect information that you voluntarily share with us and automatically collected through use of the Site. You may browse the Site without disclosing any personal information. However, in order for you to make a purchase through the site, register your account, or sign up for our e-mail newsletter, we may require that you furnish personal information or allow access to collect the same, such as:

  • Contact information, such as your name, physical address, telephone number, and email address;
  • Information about your location, such as the zip code or postal code where your base is located;
  • Billing and financial information, such as credit or debit card number, expiration date & security code and/or information regarding your PayPal, Google Wallet or other digital payment accounts.

Note: Although users can submit credit card or other payment card information to pay for a service through the Site, we do not receive this information. Payment card information is transmitted directly to a third-party payment card processor, Square, Inc. (“Square”), through an Internet connection secured by industry-standard Secure Socket Layer (SSL), PGP, and Payment Card Industry Data Security Standard (“PCI-DDS”), Level 1, and/or similarly evolving encryption technology. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. Square then communicates to us whether your payment has cleared, but does not provide payment information to Root Recruiting. Square’s privacy policy is available here.

  • Anonymous or aggregated data that is not personally identifiable to you;
  • Log-in information, items in your checkout basket, and other session information captured and saved by cookies and other technologies; and
  • IP addresses.

Surveys

If you choose to participate, you may complete surveys on the Site about your experience, such as your level of satisfaction with the Site, your engagement with the Store, and your awareness of products in the Store. In some cases, we may link the information you provide in the survey with Personal Information in your account. When linked to Personal Information, your survey information becomes Personal Information.

  1. b) Information We Collect Through Technology

We collect information through technology to enhance our ability to serve you. When you access and use the Site, we and, in some cases, our third-party service providers such as Square collect information about how you interact on our Sites. We do this through various ways.

When you visit the Site, we collect your Internet Protocol (IP) address. An IP address is associated with the portal you used to enter the Internet, like your Internet service provider (ISP), company, association, or university. We may link the last IP address you used to access the Site to Personal Information you provide us.

We may also collect a unique identifier for your computer, mobile device, or other device used to access the Site (“Device Identifier”). A Device Identifier is a number that is automatically assigned to the device you used to access the Site. We may link the Device Identifier to other information about your visit, such as what pages you viewed, and to Personal Information you provide us.

We may also use cookies, which are small files that contain information about the websites you visit and remember your preferences, improving your user experience. We only use first-party cookies, which are cookies placed by us on our websites. We may include small graphic images or other web programming code, called web beacons (also known as “pixel tags”, “web bugs” or “clear GIFs”), in our web and mobile pages and messages. The web beacons are minute graphics with a unique identifier. They are used to track the online movements of Web users. In contrast to cookies, which are stored in a user's computer hard drive, web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. Web beacons help us better manage content on the Site by informing us what content is effective, monitoring how users navigate the Site, counting users of the Site, and counting how many e-mails sent by us were actually opened. 

“Do Not Track” Browser Setting (California Disclosure)

Our Site do not support the Do Not Track (DNT) browser setting. DNT is a preference you can set in your browser's settings to let the websites you visit know that you do not want the websites collecting your Personal Information.

We do track your online activities over time and across third-party websites or online services. For example, we use web beacons to help us determine what links or advertisers brought you to our Site. We also use third-party service providers to display advertisements to you on other websites based on your activities while on the Site.

  1. c) Information Collected from Mobile Devices

When you access the Site with your mobile device, we may automatically collect and store some or all of the following information from your mobile device (“Mobile Device Information”), including, but not limited to the type of Internet browsers you use with the Site; preferred country site; your mobile operating system; your phone number or other identifiers assigned to your mobile device, including the IP address of your mobile device, the manufacturer and model of your mobile device.

We may link your Mobile Device Information and App Usage Information to Personal Information you have provided us, in which case we will treat the combined information as Personal Information.

  1. d) Information You Provide About A Third Party

If you choose to use our referral service to tell a friend about the Site, we may collect your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Site. We store this information only to send this one-time email and to track the success of our referral program. We do not use this information for any other marketing purpose unless we obtain consent from that person or we explicitly say otherwise. Please be aware that when you refer a friend, your e-mail address may be included in the message sent to your friend.

  1. e) Information Third Parties Provide About You

We may supplement the information we collect about you through the Site with records received from third parties in order to enhance our ability to serve you, to tailor our content to you, and to offer you information that we believe may be of interest to you.

We will apply this Privacy Policy to any Personal Information received from third parties, unless we have disclosed otherwise.

  1. f) Information You Provide to a Third Party

The Site may include links to sites or applications operated by third parties (“Third-Party Sites”) and plug-ins from Third-Party Sites. We do not control any Third-Party Sites, and is not responsible for any information they may collect. The information collection practices of a Third-Party Site are governed by that site's privacy policy. We recommend that you read any Third-Party Site's privacy policy if you choose to enter any Third-Party Site or click on a plug-in. Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy.

  1. HOW WE USE THE INFORMATION WE COLLECT

We use the information we collect to serve our customers, market and promote our products, and improve your experience at the Site. Some examples of such include:

  • Communicating with you;
  • Improving customer service;
  • Managing payments for products;
  • Troubleshooting technical problems;
  • Marketing products and services;
  • Responding to questions and feedback;
  • Preventing, discovering and investigating violations of this Privacy Policy or any applicable terms of service or terms of use, and investigating fraud, chargebacks or other matters; and
  • Contacting you with regard to your use of the Site and, in our discretion, changes to the Site and policies.

By using the Site, you expressly consent and agree to accept and receive communications from us, including via e-mail, text message, calls, and push notifications to the cellular telephone number you provided to us. Standard text messaging charges applied by your cell phone carrier will apply to text messages we send, if you opt-in. You acknowledge that you are not required to consent to receive promotional messages as a condition of using the Site. You may opt-out of receiving promotional or marketing texts or calls from The Cove Gifts at any time.

The information described in this section may be transferred to, or processed and stored in, the United States and other countries, which may employ greater or less restrictive data protection laws. In all cases, we will attempt to take appropriate measures to protect your personal information in accordance with the policies described herein.

  1. Data Retention

To preserve the integrity of our databases, we may retain information submitted by Users for an indefinite length of time. If required by law, we will delete Personal Information by erasing it from our database. We will also respond to User requests to delete or correct account or Personal Information, which you can do by contacting us.

  1. Analytics

We may use third-party web analytics services on the Site, such as those of Google Analytics. These service providers use the sort of technology to help us analyze how users use the Site, including by noting the third-party website from which you arrive. The information collected by the technology will be disclosed to or collected directly by these service providers, who use the information to evaluate your use of the Site. We also use Google Analytics for certain purposes related to advertising, as described in the following section. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-Out Browser Add-on.

  1. Tailored Advertising

Third parties whose products or services are accessible or marketed via the Site may also place cookies or other tracking technologies on your computer, mobile phone, or other device to collect information about your use of the Site in order to (a) inform, optimize, and serve marketing content based on past visits to our websites and other sites and (b) report how our marketing content impressions, other uses of marketing services, and interactions with these marketing impressions and marketing services are related to visits to our websites. We also allow other third parties (e.g., ad networks and ad servers such as Google Analytics, DoubleClick, Facebook and others) to serve tailored marketing to you and to access their own cookies or other tracking technologies on your computer, mobile phone, or other device you use to access the Site. We neither have access to, nor does this Policy govern, the use of cookies or other tracking technologies that may be placed on your computer, mobile phone, or other device you use to access the Site by non-affiliated, third-party ad technology, ad servers, ad networks or any other non-affiliated third parties. Those parties that use these technologies may offer you a way to opt out of targeted advertising as described below. You may receive tailored advertising on your computer through a web browser. Cookies may be associated with de-identified data linked to or derived from data you voluntarily have submitted to us (e.g., your email address) that we may share with a service provider in hashed, non-human readable form.

  • HOW WE SHARE THE INFORMATION WE COLLECT

We do not sell, rent, or trade your Personal Information to third parties other than as disclosed in this Privacy Policy at the time you provide your information. The following are some of the ways we share your information:

  1. a) On the Site

Certain information we collect will be displayed on your profile on the Site for view by registered users, including your name and certain other Personal Information you provide us. Your Personal Information will not be available to other Users.

  1. b) Third Parties Providing Services on Our Behalf

Third party companies and individuals provide or facilitate certain aspects of the services offered through the Site on our behalf. We may provide these third-party service providers with access to your information, including your Personal Information, so that they can perform these services for us. We require these third-party service providers to provide safeguards for your Personal Information similar to the ones that we provide.

The following are some examples of how we share your information with third-party service providers.

  • We retain third-party service providers to help us perform data analytics regarding your interactions with the Site. For example, Google Analytics (privacy policy here) may track what pages users visit on the Site, whether users use any coupon codes, and what services users request to determine how users use the Site.
  • We may disclose your Personal Information to an attorney in the process of obtaining legal advice.
  • We use Square, a third-party service provider, to facilitate sale of products and process any billing information, including credit card information you submit.
  1. c) Administrative and Legal Reasons

Required Disclosures:

We may be required to disclose Personal Information for legal reasons, such as in response to a court order, subpoena, civil discovery request, other legal process, or as otherwise required by law.

Legal Compliance and Protections:

We may disclose account and other Personal Information when we believe disclosure is necessary to comply with the law or to protect the rights, property, or safety of The Cove Gifts, our users, or others. This includes exchanging Personal Information with other companies and organizations for fraud prevention and credit risk reduction.

  1. d) Corporate Transactions

We reserve the right to disclose and transfer your information, including your Personal Information:

  • To a subsequent owner, co-owner, or operator of the Site or successor database.
  • In connection with a corporate merger, consolidation, the sale of substantially all of our membership interests and/or assets or other corporate change, including to any prospective purchasers.
  1. CHILDREN'S ONLINE PRIVACY PROTECTION ACT COMPLIANCE

Our Site is not targeted to children under thirteen (13) years of age and we do not knowingly collect Personal Information from children under 13. If we discover that we have inadvertently collected Personal Information from a child under 13, we will promptly take measures to delete that Personal Information from our systems. In the case of residents of the European Union, we do not collect Personal Information from anyone under the age of 16 except with parental consent, subject to an EU member state providing by law for a lower age (not below 13 years).

The Site, and products, and services offered through it, are all directed to people who are at least 13 years old or older. If you are under the age of 13, you are not authorized to use the Site.

  1. CALIFORNIA ONLINE PRIVACY PROTECTION ACT COMPLIANCE/YOUR CALIFORNIA PRIVACY RIGHTS

California residents who use the Site may request that we provide certain information regarding our disclosure of your Personal Information to third parties for their direct marketing purposes. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of Personal Information we collected about you.
  • The categories of sources for the Personal Information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of Personal Information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: sales, identifying the personal information categories that each category of recipient purchased; and disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

  1. HOW WE PROTECT THE INFORMATION WE COLLECT

The security and confidentiality of your Personal Information is important to us. We have implemented technical, administrative, and physical security measures to protect your Personal Information from unauthorized access or disclosure and improper use.

For example, when Users purchase products, the information they input is encrypted through SSL encryption. We do not store credit card information on our servers, and we use SSL encryption to protect your credit card information when it is transferred to our third-party payment processor. In addition, access to your Personal Information is restricted in our offices. Only employees who need the Personal Information to perform a specific job, for example, sales representatives, managers, and customer service staff, are granted access to Personal Information. All employees with access to Personal Information are kept up-to-date on our security and privacy practices. After a new policy is added, these employees are notified and/or reminded about the importance we place on privacy, and what they can do to enhance protection for our Users’ Personal Information.

It is important for you to protect against unauthorized access to your account password and to your computer. Be sure to log out of your account or to close your browser after you have completed your visit to our Site.

Please note that despite our reasonable efforts, no security measure is ever perfect or impenetrable, so we cannot guarantee the security of your Personal Information.

  • YOUR CHOICES REGARDING THE INFORMATION WE COLLECT

You may contact contact@thecovegifts.com to update, correct, or delete your Personal Information. You may also update, correct, and delete some of your Personal Information through your account on the Site.

In addition, you may cancel or modify the email communications you have chosen to receive from the Site by following the instructions contained in emails from us.

  • INTERNATIONAL USERS

The Cove Gifts is based in the United States, and our offices are headquartered in the United States. Please be aware that information you provide to the Site as a result of your use of the Site may be processed and transferred to the United States, and be subject to U.S. law. The privacy and data protection laws in the United States may not be equivalent to such laws in your country of residence. By using the Site, participating in any of the service, or by providing us with your information, you consent to this collection, transfer, storage, and processing of information to and in the U.S., we will take reasonable steps necessary to ensure that your data is treated securely in accordance with this Privacy Policy.

  1. EU USERS

If you are a European Union (“EU”) resident and provide information to us, the information will be transferred out of the EU and sent to the United States. (The adequacy decision on the EU-US Privacy became operational on August 1, 2016. This framework protects the fundamental rights of anyone in the EU whose personal data is transferred to the United States for commercial purposes. It allows the free transfer of data to companies that are certified in the US under the Privacy Shield.) By providing personal information to us, you are consenting to its storage and use as described in this Privacy Notice.

  • The right to receive your Personal Information from us in a structured, commonly used and machine-readable format, and the right to transmit your Personal Information to another controller without hindrance from us (data portability).

If you are located in the EU and you are or have been our customer, we may send you marketing communications based on our legitimate interests, subject always to your right to opt out of such communications. Further, if you are located in the EU, we will never share your personal information with a third party for such third party’s marketing purposes, unless you have specifically consented to us doing so.

You may contact us at contact@thecovegifts.com to exercise any of the above rights. We may request specific information from you to confirm your identity, and in some circumstances, we may charge a reasonable fee for access to your Personal Information.

Furthermore, if you believe that our processing of your Personal Information is inconsistent with your data protection rights under the GDPR and we have not adequately addressed your concerns, you have the right to lodge a complaint with the data protection supervisory authority of your country. For purposes of the GDPR, we are a “controller” and you are a “data subject.”

We will post those changes on this page. If we materially change this Privacy Policy in a way that affects how we use or disclose your Personal Information, we will notify you by prominently posting a notice of such changes before making them and by stating the effective date of the changes.

First off, THANK YOU for your business! We hope you enjoy your purchase but we understand that sometimes things just don’t work out. Below are the steps you need to take to make a return to The Cove Gifts!

  1.  Shoot us an email at contact@thecovegifts.com Include your order number and what you would like to return. This must be done within 5 business days of receiving your order. We will email you once your return in confirmed.
  2. After you receive our confirmation, ship the item(s) back to the address : The Cove Gifts Attn: Returns, 1580 Keller Pkwy Ste.50A, Keller, TX 76248
  3. All items must be shipped to The Cove Gifts with “returns” as the attention. Return shipping is a the expense of the customer. All returns must be post marked within 7 business days of return confirmation email. We are not responsible for any packages lost or missing during the shipping process. We recommend using a shipping provider that offers tracking. 


ALL SALE and DISCOUNTED merchandise is ALL SALES FINAL. This includes but is not limited to flash sales, holiday sales, special event products and clearance merchandise or any other type of discount. “Special event products” refer to masks, gloves, sanitizers, cleaning products, consumable paper products, flashlights, extension cords, lanterns, lamp oil and lamps. As events unfold new items may be added to this list at any time. 

All unworn and approved returns will be issued onto the original form of payment. All items must be returned to us in their original condition. The original condition means that it still has original tags, is unworn or washed and is FREE from smoke, sweat, deodorant, make-up and perfume. 
 
Damaged or Defective Items:
At The Cove Gifts we thoroughly check all of our items for any damages or defects before shipping you product. Since we are human and sometimes make mistakes we do take returns on damaged or defective items. To make a claim follow the steps below.

  1. Report damages to contact@TheCoveGifts.com within 5 days of receiving your product or it will NOT be accepted. Please include your first, last name, order number, a description of what is damaged or defective and a picture of the product. 
  2. All returning items must be sent to us in their original condition. The original condition means that it still has original tags, is unworn or washed and is FREE from smoke, sweat, deodorant, make-up and perfume. 
  3. Due to limited quantities of apparel and jewelry, we may not be able to offer direct exchanges but we will do whatever we can to make the situation right. If you are needing a different size or color of an item, you can email us and as long as we have the product in stock we will ship you the correct one once we receive the wrong size or color back.
